Sid - as a matter of interest does Hull I's stand in the way of players who wish to play at a higher level? I thought most clubs were happy to let players go if they were going to play at a higher standard.

Sure Roth might be naughty by announcing it before the player was released but taking it "further" - what does that mean?

I think French Connection and Camquin have provided your answer.

It is not a question of standing in the way of a player who wants to play at a higher level.
Is there no onus on the player to respect the contract he and the Club signed in good faith and, accept some responsibility.

I think I know how your coach would react under similar circumstances.

I was under the impression that clubs usually built in a clause stating that if a club from a higher league expressed interest in signing a player the club would release said player.

I am by no means justifying these actions just asking the questions to enable further learning and understanding. I will be interested in seeing how this pans out over the next couple of weeks then.

We certainly did not have such a clause in  our contracts, and I haven't heard of any others who did. I always made it perfectly clear to a player before he signed a contract that by doing so he would be tied to us for the season whoever may be interested in him in the future, although we did include an 'escape clause' which would allow the player to get out of his contact at the end of October if he wished to. This was to allow for the fact that the player may sign in the summer thinking he'd be in the first team but then a number of better players arrived later and he couldn't get near. That clause was used twice in 6 years with over 30 players contacted each year.
Having said that, I actually don't think that such a clause allowing a player to move to a club in a higher division is such a bad idea, but it could make things even harder for DoRs.

You might find that the player thought he had a verbal agreement with the club on this issue.

Verbal agreements count for nothing at all legally. Unless it's in writing on a signed and official contract the club (Ionians in this case) can do as they like - they may wish to let him go or they may not. My advice to all players is to think long and hard before signing a contract and actually read it thoroughly before doing so, and then ask for things to be added or taken out if they want that. This is a case in point. As DoR I used to go through all the bits and bobs with the player and made sure he understood everything before he signed. 
I also know of cases even at levels 4 and 5 where a club from a higher division has bought a player out of his contract with a lower level club.
