This morning I receieved an email from my hosting company about an infringement of copyrighted material.
The full email is below with contact details removed. You dont need to read it unless you wish, however you need to take care with images used as logos, images uploaded on to the website just as much as you do with what you say.
I have removed the item which I believe to have been done in error and without knowing it was a registered design.

REGISTER ENTRY FOR DESIGN NUMBER 4008057 At the IPO including the colour black which covers all colours are registered for this particular design.

Well that is written in typical legalese, except for the incorrect English here and their. I do have some sympathy for his standpoint though.
The problem is that the only way to fully prove his point is to show his design alongside the logo about which he complains. A rugby club, or its supporters' club, which comes from Penzance (or Camborne) is almost bound to have a pirate skull and crossbones with a St. Piran flag in its design. I should know as several along those lines were done for Mounts Bay RFC, in the spring of 2008 by me and others in the design-a-logo competition run by the club. One design, similar to the final one used for the club logo was: This was the combined effort of several people: text by Mountie, St Piran eyepatch by a well known exile in Cheshire. I presume the final design for Mounts Bay was registered. The earlier trial designs were not, but I wonder whether one of them might not have been the spark for the design referred to by Mark Gabriel. It is all too easy to copy things from the internet. We are probably all guilty of it on occasions. I did note one of my photos being used on here a week or two back, having been offloaded from flickr. I did think of firing a complaint, but I thought that might be a little churlish. It would be good if people would quote the source of photographs (and suchlike) when they are reposted. I did get accused (nicely) by a professional photographer of lifting one of his photos. When I looked at his website we had identical shots of Tom Varndell running in a try for Leicester against Ospreys in the Anglo-Welsh cup final, April 2007. (He subsequently was most helpful in advising me about buying new equipment.)

Ha ha! Heaven forbid additional brand exposure for a rugby club on a rugby forum. The implications are terrible - it might whip up more supporters, more travelling away fans and more online sales! Quick, get legal with them now!!!
That kind of over-protective zealous attitude is entirely counter-productive in today's internet age of syndicated and distributed content. I'm guessing the person in question still thinks viral content needs treating by a doctor...

Hmm...curious. The Press Gang has disbanded but the logo is still used on the unofficial Pirates fans' forum along with club badge, etc. The complainant doesn't say [I think] what his logo was registered for but as Dave H says, it's tricky to avoid the use of eye patches, bandanas, etc.
The Pz & Newlyn club logo was, I hope, registered many years ago[Pz &N being, of course, the parent club of Cornish Pirates]. As it also features pirate, bandana and eye patch, is there scope for a counter action against MG?
Or perhaps the descendants of Gilbert & Sullivan have a case.........

His logo seems to be registered for his flag business, and it seems to me that he's trying to throw his weight around to get more attention or cash. The claim surrounds the use of a skull rather than a pirate, and that's where the press gang logo rather than the pirates one seems to conflict.

The daft thing here is that the logo on the Pirates unnoficial site is not subject to copyright and MG cannot do anything about it. The logo on my previous avatar differs from the one on the Pirates site only slightly.
CP Unoffy site logo has skull with St Piran's flag as the bandana and wearing a red eye patch.
MG's logo has a skull with a black eye patch and the bandana is red.
Go figure!.
